This agreement becomes effective and binding once you approve it and begin registering in the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.
Article 1 – Introduction and Definitions
The above introduction is considered an integral part of this agreement. Below are the meanings and definitions of the key terms used in this agreement:
1. Store: This definition includes all forms of the store on the internet, whether an electronic application, a website, or a physical commercial shop.
2. Consumer: The person who engages in e-commerce with the aim of obtaining the products or services provided by the store through its electronic platform.
3. Agreement: Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article 2 – Consumer’s Legal Eligibility
1. The consumer acknowledges that they possess the legal capacity recognized by Sharia and law to deal with the store, or that they are at least 18 years of age.
2. The consumer agrees that if they violate this article, they shall bear the consequences of such violation before third parties.
Article 3 – Nature of the Commitment
1. The store’s obligation toward consumers is to provide the service or product.
2. The store may also provide other services such as after-sales services or related services depending on the nature and type of the service or product requested by the consumer.
Article 4 – Rules of Use
1. The consumer must use the store’s electronic platform in a manner consistent with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2. When purchasing any service or product from the store, the consumer must not use it in a way that violates public morals or the regulations in force in the Kingdom of Saudi Arabia.
Article 5 – Accounts and Registration Obligations
When applying to join the store as a user, you are required to disclose certain information and choose a username and a confidential password to access the store’s services. By doing so, you agree to the following:
1. You are responsible for maintaining the confidentiality of your account information and password and agree to notify the store immediately of any unauthorized use of your account or any other breach of your confidential information.
2. The store shall not be responsible under any circumstances for any direct or indirect loss—moral or material—that may result from the disclosure of your username or password.
3. You agree to use your account personally, and you are fully responsible for it. If another person uses it, this is considered evidence that you have authorized them to use the store on your behalf.
4. You agree to use the store seriously and in good faith.
5. You agree to provide true, accurate, current, complete, and lawful information about yourself as required during registration and to update your information when necessary.

2. The consumer agrees that all agreements, notices, statements, and other communications provided electronically shall take the place of written communications and constitute valid legal evidence.
3. The consumer agrees that the store administration may communicate with them regarding matters related to this agreement or transactions through general messages sent to all consumers or specific users of the store.
Article 7 – Amendments to the Terms of Use and Fees
1. If any provision or clause in this agreement is canceled or becomes invalid, this shall not affect the validity of the remaining provisions and terms of the agreement, which will remain in effect until further notice from the store administration.
2. This agreement—subject to amendment from time to time—constitutes the framework governing the relationship and understanding between the consumer and the store.
3. The store may impose fees on some consumers depending on the offers, products, or services requested or according to any government-imposed taxes or fees related to the product or service.
4. The store reserves the right to add, increase, reduce, or deduct any fees or expenses according to the terms and provisions of this agreement.
Article 8 – Payment and Settlement Services
1. The store provides payment and settlement systems through its partners. Payment may be made fully online through the available payment options or through any payment method provided by the store from time to time.
2. The store is committed to specifying the price of the service or product offered according to the prevailing market value.
3. The store is committed to issuing invoices, receipts, and payment confirmations for all amounts and profits generated, and to providing the consumer with a purchase invoice.
4. The store is committed to applying recognized accounting standards in its online store in accordance with the provisions of this agreement and for legal, economic, commercial, and organizational purposes.
Article 9 – Intellectual Property
1. All intellectual property rights of the store are fully owned by the store, whether owned before or after the establishment of this electronic platform.
2. The consumer must respect the store’s intellectual property rights, including the

Article 10 – Store Liability
1. The store is committed to conducting its business through this electronic platform in compliance with the regulations in force in the Kingdom of Saudi Arabia and in accordance with this agreement.
2. The store is not responsible for any claims arising from errors or negligence, whether direct, indirect, incidental, or caused by the consumer or by a third party such as shipping companies.
3. DEAR GARDENIA Flowers Store, its employees, owners, and representatives commit that the product or service provided is lawful, authorized, and compliant with the laws and regulations of Saudi Arabia and used for legitimate purposes.
Article 11 – Restricting Access or Membership
The store may suspend, cancel, or restrict a consumer’s access to the platform’s services at any time, without prior notice and for any reason.
Article 12 – Governing Law
This Terms of Use Agreement is governed and interpreted according to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and it is fully subject to the applicable regulations of the Saudi authorities.
Article 13 – General Provisions
If any provision of this agreement is canceled or becomes invalid, this shall not affect the validity of the remaining provisions, which shall remain in force until further notice from the store administration.
This Terms of Use Agreement—subject to modification when necessary—constitutes the agreement governing the relationship, cooperation, and transactions between the store and the consumer. Both parties agree to the following:
1. Arabic is the official language used when interpreting the provisions of this agreement or translating it into another language.
2. All prices displayed for the store’s services or products may be modified from time to time.
3. Promotional or marketing offers provided by the store are temporary, and the store has the right to modify or discontinue them at any time.
4. The parties agree to deal with each other in a manner that does not violate Islamic principles, laws, or regulations governing the relationship between the store and the consumer.
5. This Terms of Use Agreement may only be canceled by a decision issued by the store administration.
